When the Other Driver Can't Pay
Every other coverage assumes someone can pay for the harm. This is the one that answers what happens when nobody can.
The two halves
Uninsured motorist covers you when the at-fault driver has no insurance at all — including, in many policies, a hit-and-run driver who's never identified. Underinsured motorist covers the gap when they have coverage but not enough to cover what they did.
Why the underinsured half matters more than it sounds
California's minimum property damage limit is $15,000. A driver carrying exactly the state minimum, who totals a newer car, may leave a real gap between what their policy pays and what your car was worth. They're fully insured under the law and still short.
The context for California drivers
Industry estimates have long put roughly one in six California drivers on the road without insurance. That's an estimate, not a precise count — but it's the reason this coverage gets more attention here than in some other states, and it matches the pattern of the calls our office takes.
It's offered, and you can decline it
Insurers are required to offer uninsured motorist coverage in California, and you may reject it in writing. Plenty of people do without registering that they did. Check your declarations page — if you see it declined and don't remember choosing that, it's worth revisiting.
What it typically covers
Injuries to you and your passengers, and in some forms property damage. The specifics and available limits vary by carrier, so ask how yours is structured rather than assuming the shape.
Ask to see it quoted with and without — the difference is often smaller than people expect.
Check your declarations page for a rejection you do not remember
Because this coverage must be offered and may be declined in writing, a surprising number of people carry a rejection they have no memory of making — signed once, years ago, on a policy that has since renewed a dozen times. The rejection carries forward. Find the line on your declarations page and see which way it reads. If it says the coverage was rejected and that was not a deliberate decision, it can usually be added back with a phone call.

Do I need this if I have good health insurance?
They cover different things — health insurance addresses medical bills, while this can also address other losses and your passengers. Look at both before deciding it's redundant.
Does it cover a hit-and-run?
Often yes, which is one of its most valuable uses, though requirements like reporting the incident promptly can apply. Ask how your specific policy handles it.
Will using it raise my rates?
You weren't at fault, and carriers treat not-at-fault claims differently than at-fault ones. Practices vary by company, so ask yours directly.
